Appellate

A case doesn't necessarily end with the final judgment of a trial court. Appeals made to higher levels of courts can reverse an unfavorable verdict or clarify a question of outstanding law.

At the appellate stage, strong written advocacy and a clear grasp of statutory law and case precedent are of primary importance. We have experience teasing out the nuance in difficult arguments and precise factual scenarios and clarifying your arguments for presentation to an appellate panel.

Representative appellate actions include:

  • advocacy to the Fifth Circuit regarding issues of correct standards of proof at the summary judgment stage, hearsay, the independent intermediary doctrine, and the right to film police;
  • advocacy in state appellate courts regarding defamation, the Texas Citizens' Participation Act, jurisdictional issues, and standards for summary judgment disposition.
